Terms and Conditions

By accessing this webpage, you agree to be bound by these Terms and Conditions (“Terms”) in a legally binding agreement between Deccan Watches LLP (“Merchant”, “we”, “us” or “our”) and the User (“you” or “your”). If you do not agree to these Terms, you may not access the Platform.

We may update these Terms by posting changes to the Platform. Please check this page periodically. If an amendment is not acceptable to you, stop using the Platform.

1. Eligibility

You represent and warrant that you have the right, power and authority to agree to these Terms, become party to a legally binding agreement and perform your obligations under them.

2. Definitions

Payment Instrument: Credit card, debit card, bank account, prepaid payment instrument, UPI, IMPS or another payment method made available by banks and financial institutions.
Platform: The website or platform where the Merchant offers products or services and a Transaction may be initiated.
Transaction: An order or request placed by a User to purchase products or services listed on the Platform by paying the Transaction Amount.
Transaction Amount: The amount paid by the User in connection with a Transaction.
User: Any person using the products or services offered on the Platform.
Website: The Deccan Watches website and its associated pages, services and checkout experience.

3. Merchant’s rights

We may collect, store and share information you provide to deliver products or services and contact you about the same, in accordance with our privacy practices and applicable law.

4. Your responsibilities

You agree to provide true, complete and current information required to complete Transactions, including your name, email address, phone number, delivery address, age, gender where requested and accurate payment information.

5. Prohibited actions

You may use the Platform only for its intended purpose. You must not:

Systematically retrieve data to create a database or directory without our written permission.
Collect usernames or email addresses for unsolicited messages, or create accounts by automated or false means.
Circumvent, disable or interfere with security features or copying restrictions.
Trick, defraud or mislead us or other users, including to obtain sensitive account information.
Abuse support services, submit false reports, use bots or conduct data mining.
Interfere with, disrupt or place an undue burden on the Platform or connected services.
Impersonate another person or use another user’s account.
Use information from the Platform to harass, abuse or harm another person.
Use the Platform or its Content for competing, revenue-generating or unauthorised commercial activity.
Decipher, decompile, disassemble, reverse engineer, copy or adapt Platform software or code.
Upload viruses, Trojan horses, spam or material that interferes with another person’s use of the Platform.
Disparage or otherwise harm us or the Platform, or act contrary to applicable law.

6. Limitation of liability and indemnity

For a defective product, service deficiency or product that does not match its description, the User’s recourse is to initiate a refund or other remedy under the applicable policy. To the extent permitted by law, we disclaim liability for consequential losses. You agree to indemnify and hold harmless the Merchant, its affiliates, agents and representatives from claims, losses, damages, costs and expenses arising from your breach or alleged breach of these Terms.

7. Reviews and ratings

Where reviews or ratings are available, you must have firsthand experience and must not publish profanity, abusive, racist, hateful, discriminatory, illegal, false or misleading content. You must not post competitor-affiliated reviews, make legal conclusions or organise campaigns to influence reviews.

We may accept, reject or remove reviews at our discretion and are not obliged to screen them. Reviews do not necessarily represent our views or those of our partners. By posting a review, you grant us a perpetual, non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to reproduce, modify, translate, transmit, display, perform and distribute its content.

8. Governing law and dispute resolution

These Terms and their subject matter are governed by the laws of India. The courts of India have exclusive jurisdiction, subject to the arbitration agreement below.

Any dispute arising out of or relating to these Terms shall be referred to and finally resolved by arbitration in Bengaluru under the Arbitration and Conciliation Act, 1996. The parties will seek to agree on a sole arbitrator within 30 days of a notice of dispute; otherwise appointment will proceed under that Act. The seat is India and proceedings will be in English. The arbitration and materials will remain confidential except where disclosure is required by law. The award is final and binding. Either party may seek suitable interim or injunctive relief from the courts in Bengaluru. Costs will be allocated by the arbitrator.

9. Grievance redressal

For questions or complaints about a product, service or Transaction—including duplicate debits, fraudulent or unauthorised Transactions and refund requests—contact us through the public contact details on the Social page.

10. Disclaimer

When you initiate a Transaction, you enter into an enforceable contract to purchase the selected products or services and must pay through legitimate funds and accepted Payment Instruments. Provide accurate payment details to the secure payment system. Information may be used or shared for fraud verification or where required by law, regulation or court order.

We disclaim liability for unauthorised use of a User’s Payment Instrument and for loss arising from declined authorisation, malfunction, errors or unscrupulous activity, to the extent permitted by law. Treat any user ID, order ID, password or security information as confidential.

Platform content is for general information and is not advice. Third-party links are provided for convenience and are not endorsements. User-uploaded information is not necessarily verified or approved by us and does not represent our views. We do not guarantee that the Platform is secure or free from bugs or viruses. You are responsible for your own device configuration and virus protection.
